End User License Agreement (EULA)

Effective date: October 20, 2026

This End User License Agreement ("Agreement") is a binding legal contract between you ("User," “you”) and LitFinger Studio s.r.o. ("Developer," “we,” “our,” or “us”) regarding your use of the mobile application “Nourish” (the “App”). By installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not install or use the App.

1. License Grant

1.1. Subject to this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to download, install, and use the App on compatible mobile devices that you own or control, strictly for personal, non-commercial purposes. If you download the App onto an Apple-branded device, Section 20.2 also limits that licence.

1.2. Licensed, not sold. The App is licensed, not sold, whether you obtain it from Apple’s App Store, Google Play, or another permitted source. This licence does not constitute a sale of the App and does not transfer any intellectual property rights in it. You receive only the limited right of use described in this Agreement.

2. Intellectual Property Rights

2.1. All rights, title, and interest in and to the App, including but not limited to source code, object code, text, design, trademarks, service marks, graphics, logos, and other materials (except open-source components used under their respective licences), remain the exclusive property of the Developer or its licensors.

2.2. Nothing in this Agreement shall be construed as granting any ownership rights to you in respect of the App.

3. Restrictions on Use

You agree not to:

  • Copy, reproduce, distribute, publicly display, or create derivative works from the App, except as permitted by mandatory law;
  • Decompile, disassemble, reverse engineer, or attempt to derive the source code of the App, except to the extent expressly permitted by applicable law;
  • Rent, lease, sell, sublicense, or transfer the App or a purchase to any third party, except as the app store’s rules allow (including, for an App Store copy, Family Sharing, volume purchasing, or Legacy Contacts);
  • Use the App for unlawful, harmful, or unauthorised purposes;
  • Introduce viruses, malware, or other harmful code;
  • Circumvent or attempt to circumvent security measures of the App;
  • Use the App in any situation where distraction could endanger health or safety (for example while driving or operating hazardous machinery).

4. Eligibility and Use by Minors

4.1. Age requirements: The App is not directed at children under 13. Users under 13 may not use the App without verifiable parental consent where required by law (including COPPA in the United States).

4.2. Users 13–17: Should use the App with parental knowledge and supervision where local law or clinical guidance expects it.

4.3. Users under 13: Must have verifiable parental consent before using the App in jurisdictions that require it.

4.4. Parental responsibilities: Parents and guardians are responsible for monitoring minors’ use, understanding the App’s features, and exercising rights under applicable child-privacy laws.

4.5. Content in the App: Educational and support content is intended to be age-appropriate for teens and adults using the product for recovery support; it is not a substitute for professional care (see Section 5).

4a. Optional accounts and cloud sync

4a.1. An account is optional. Credentials must be accurate. You are responsible for your password and recovery key. One person per account; do not share credentials.

4a.2. Continuous multi-device sync is available to anyone with an account. You control scopes; core profile is required when sync is on. Content is encrypted on your device before upload. We cannot recover journal content without your secrets. Losing both password and recovery key may mean permanent loss of the cloud backup. Local use continues offline. Availability is best-effort.

4a.3. Do not upload other people’s sensitive data without rights. Do not abuse the API or share an account to scrape data.

4a.4. Future therapist sharing is not included in this version. If added, it will require separate consent.

4b. Paid features, subscriptions, and tips

4b.1. The App is free to install, and core recovery tools stay available without payment. Optional paid items are:

  • Nourish Premium, an auto-renewing subscription billed either monthly (nourish.premium.monthly) or yearly (nourish.premium.yearly). Both plans unlock the same Premium features while that subscription is active;
  • the Cats theme pack (nourish.theme.cats) and the Noir theme pack (nourish.theme.noir), each a one-time, non-consumable purchase of that appearance only;
  • tips (ā€œSupport Nourishā€), which are consumable purchases that unlock nothing.

4b.2. In-app payments are processed by Apple or Google under their terms, including payment, tax, billing, and refund rules. We do not receive your payment card details. Before you confirm, the store shows the price, the billing period, and, for Premium, that the subscription renews automatically. What we store about a signed-in purchase is described in the Privacy Policy.

4b.3. Subscriptions renew automatically for the price and period shown at purchase (one month or one year) until you cancel. The store charges the Apple or Google account you use to confirm the purchase, including each renewal. Cancel at least 24 hours before the end of the current period in your App Store or Google Play subscription settings. We cannot cancel a store subscription from inside the App. Deleting your Nourish account or uninstalling the App does not cancel the subscription or stop renewal. Apple or Google handles refunds of store purchases, including subscriptions and one-time theme packs, under their policies; we do not refund store purchases ourselves. We do not currently offer a free trial. If we add one, the store listing will say so before you confirm, and any unused trial period is forfeited when you purchase a subscription, as required by the store.

4b.4. Premium, while the subscription is active, includes the extra features described in the App: deeper self-care (Returning to Yourself and Circle of Support), Pleasant Moments, courage tools (Steps Toward Life or Health, and the Courage Map), sleep check-ins, medication reminders, meal-structure tools (Recovery Plate, Build Your Plate, and Meal Rhythm), every theme pack we currently offer or later add (including Cats and Noir). Encrypted cloud backup is available to anyone with an account (Section 4a). Classic and Monsters themes stay free without Premium. When Premium ends, the Premium features lock again. Content you already created stays on your device. A separate one-time Cats or Noir purchase is not removed when Premium ends. Cloud-backup behaviour is in Section 4a. We update a signed-in entitlement when the App next confirms the purchase with the store; until that check, a cancellation or expiry in the store may not yet show in the App.

4b.5. The Cats and Noir theme packs change appearance only. A one-time purchase of either pack remains after Premium ends and does not include other Premium features. Encrypted cloud backup is available to anyone with an account. While Premium is active, both packs are included without a separate purchase. Classic and Monsters stay free.

4b.6. Use Restore purchases in the App with the same store account that bought the item. If you are signed in, we attach store-confirmed Premium, Cats, and Noir entitlements to that Nourish account. Another account may use a purchase only where the store allows it, including Apple Family Sharing, volume purchasing, or Legacy Contacts. Do not otherwise share a purchase across people. We may refuse a restore the store does not confirm.

4b.7. Tips in the App and on the website (Stripe or, where offered, Sberbank) are voluntary support for development. They are not charitable donations and never grant Premium, a theme pack, or any other feature. A website tip is not an in-app payment method and is not linked to your account or journal.

4b.8. We may change which features are included in Premium, or add or withdraw an optional theme pack, subject to the store’s rules and mandatory consumer law. For an active subscription, the current paid period continues until it ends. If a paid feature is withdrawn, data you already created remains yours as described in the Privacy Policy.

4b.9. If the store revokes a purchase (including for fraud or a chargeback), we may remove the related entitlement.

4b.10. If a minor buys through a store account, the account holder who approves the charge is responsible for it, including each renewal until that holder cancels the subscription in the store.

5. Medical Disclaimer and Health Warnings

Critical: read this section carefully.

5.1. Not a medical device: The App is designed for informational, educational, and supportive purposes only. It is NOT a medical device, diagnostic tool, or replacement for therapy.

5.2. No medical advice: The Developer does not provide medical, psychological, dietary, or therapeutic advice through the App.

5.3. Eating disorder disclaimer: While the App aims to support recovery, it cannot guarantee outcomes. Recovery requires professional supervision when clinically indicated.

5.4. No health guarantees: The Developer makes no representations or warranties about the effectiveness of the App for any health-related purpose. Results vary.

5.5. Professional consultation required: Do not rely on the App as a substitute for licensed healthcare professionals (physicians, psychiatrists, psychologists, dietitians, therapists, or eating-disorder specialists).

5.6. Emergency situations: If you experience a mental-health crisis, suicidal thoughts, severe medical symptoms, or any emergency, contact local emergency services or a crisis line immediately. The App is not a crisis hotline.

5.7. User responsibility: You are solely responsible for health decisions and outcomes related to your use or non-use of the App.

5.8. Consult healthcare providers: Always consult qualified professionals before changing treatment, medications, or nutrition plans.

5.9. Reminders: Medication reminders and other reminders are aids that you configure on your device. They can fail, arrive late, be dismissed, or not appear, including because of device settings, battery limits, or operating-system restrictions. A reminder is not a medical service and is not a promise that it will be delivered. Do not use the App as the only reminder for medication or care.

5.10. No responsibility for harm from use: To the fullest extent permitted by applicable law, the Developer is not responsible for any harm, injury, loss, or damage caused by using the App or by being unable to use it, including harm from relying on its content, reminders, or tools. Section 10 states those limits. Section 10.5 preserves liability that the law does not allow us to exclude.

6. User Data and Privacy

6.1. The App stores sensitive health-related and personal data on your device (see the Privacy Policy). If you turn on cloud sync, encrypted copies of the scopes you choose are stored on our Appwrite project as described in the Privacy Policy. When you submit feedback, limited information is transmitted to our backend.

6.2. You remain responsible for the accuracy, legality, and appropriateness of data you enter. Sync does not create a clinician relationship.

6.3. The Privacy Policy forms part of this Agreement. In case of conflict regarding personal data, the Privacy Policy prevails for that subject matter. You may delete your account in the App; that process is described in the Privacy Policy.

7. Updates, Modifications, and Support

7.1. The Developer may release updates, patches, or new versions. Some updates may be mandatory to continue using the App.

7.2. Maintenance and support for the App, if any, are the Developer’s responsibility, not Apple’s or Google’s. The Developer is not obligated to provide technical support beyond what this Agreement or applicable law requires, but may do so at its discretion. Apple has no obligation to provide maintenance or support (see Section 20.3).

7.3. We reserve the right to modify, suspend, or discontinue the App (in whole or in part) at any time, subject to applicable consumer law.

7.4. You are responsible for device compatibility and for keeping backups of important information where the App allows export.

8. Third-Party Services and Advertising

8.1. Third-party integration: The App may open links or hand off content to system apps (browser, email, share targets).

8.2. Third-party responsibility: The Developer is not responsible for the availability, accuracy, or practices of third parties. Use is at your own risk and may be subject to separate terms.

8.3. Content disclaimer: Third-party sites do not necessarily reflect the Developer’s views.

8.4. Advertising: The current version of the App does not display third-party advertisements or integrate ad SDKs. If advertising is added, we will update this Agreement and the Privacy Policy and comply with child-protection and platform rules.

8.5. Behavioural ads for children: The current version does not show behavioural advertising. If advertising is added later, we will update this Agreement and the Privacy Policy before it is enabled, and we will follow the platform’s child-protection rules.

9. Termination

9.1. You may terminate this Agreement at any time by uninstalling the App and, if you have an account, by using Delete account in the App or on our website. Uninstalling the App or deleting your account does not by itself cancel an App Store or Google Play subscription or refund a purchase; cancel subscriptions in the store account settings (see Section 4b).

9.2. The Developer may suspend or terminate access for abuse or unlawful use. Deletion rights under privacy law remain.

9.3. Upon termination, you must cease all use of the App and delete all copies, except copies in ordinary device backups you do not actively use.

9.4. Sections 5, 10, 11, 12, and 20 (and other provisions that by their nature should survive) shall survive termination.

10. Limitation of Liability

10.1. AS-IS basis: The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10.2. No responsibility for harm or damage: To the fullest extent permitted by applicable law, the Developer is not responsible for any harm or damage caused by your use of the App, your reliance on it, or your inability to use it. This includes health outcomes, recovery results, medical or psychological consequences, emotional distress, and decisions about treatment, medication, or nutrition. It also includes harm connected with content in the App or with a reminder that is missing, late, incorrect, or misunderstood.

10.3. Limitation of damages: To the fullest extent permitted by applicable law, the Developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or for any other harm or damage. That includes personal injury, property damage, loss of profits, loss of data (including permanent loss of an encrypted cloud backup if you lose both your password and recovery key), loss of goodwill, and other intangible losses, whether arising from use of the App, inability to use it, or loss of access to a paid feature.

10.4. Maximum liability: Subject to Section 10.5 and Section 20, the Developer’s total liability under this Agreement shall not exceed the amount you paid (if any) for use of the App in the twelve (12) months preceding the claim, or $10.00 USD, whichever is greater.

10.5. Mandatory law: Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under mandatory law. That includes, where applicable law does not allow the exclusion, liability for death or personal injury, and liability for fraud, gross negligence, or intentional misconduct. If you are a consumer, mandatory consumer rights in your country of residence remain in force, including rights that apply when a paid digital service is not supplied as agreed. For a copy from the App Store, the warranty and refund wording in Section 20.4 also remains in force.

10.6. Essential purpose: The limitations in this section are fundamental elements of the bargain between you and the Developer.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Developer and its affiliates, officers, employees, contractors, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • Your use of the App;
  • Your violation of this Agreement;
  • Your violation of any applicable laws or regulations;
  • Your violation of any third-party rights;
  • Any health-related consequences resulting from your use of the App.

12. Legal Compliance

12.1. Consumer protection: If you are a consumer in the EEA or UK, mandatory rights under local law remain unaffected.

12.2. GDPR: Where we process personal data of individuals in the EEA, we aim to comply with the GDPR; see the Privacy Policy.

12.3. Child safety: We aim to comply with applicable child-privacy laws for the features we actually ship; see the Privacy Policy for the current data inventory.

13. Governing Law and Dispute Resolution

13.1. This Agreement shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict-of-law principles, subject to mandatory consumer protections in your country of residence where you qualify as a consumer.

13.2. Dispute resolution:

  • EU consumers: You may bring proceedings in the courts of your country of residence or in the courts of the Czech Republic, in accordance with EU consumer protection laws.
  • Non-EU users: Disputes shall be resolved in the competent courts of the Czech Republic, unless mandatory law requires otherwise.
  • Amicable resolution: We encourage you to contact us first to resolve disputes amicably.

13.3. Jurisdiction for Developer: The Developer may bring proceedings against you in the courts of your country of residence or any other relevant jurisdiction, as permitted by law.

14. Export Control

You agree to comply with all applicable export and import laws and regulations.

15. Force Majeure

The Developer shall not be held liable for delays or failures in performance due to events beyond its reasonable control.

16. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by applicable law.

17. Entire Agreement

This Agreement, together with the Privacy Policy and any additional terms referenced herein (including app-store terms required by Apple or Google), constitutes the entire agreement between you and the Developer regarding the App.

18. Changes to Agreement

18.1. The Developer reserves the right to modify this Agreement at any time.

18.2. Material changes will be communicated through the App and/or app store release notes, and where required we will seek your consent.

18.3. Continued use of the App after changes constitutes acceptance of the modified Agreement where permitted by law.

20. Apple App Store

If you downloaded the App from Apple’s App Store, this section applies together with the rest of this Agreement. Where this section and another section conflict for that copy, this section prevails to the extent Apple requires these minimum terms. It does not replace Google Play’s terms when you downloaded the App from Google Play.

20.1. Acknowledgement. You and the Developer acknowledge that this Agreement is concluded between you and the Developer only, and not with Apple. The Developer, not Apple, is solely responsible for the App and its content. This Agreement does not set usage rules that conflict with the Apple Media Services Terms and Conditions or the Volume Content Terms.

20.2. Scope of the Apple licence. The licence for an App Store copy is a non-transferable licence to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts associated with the purchaser may access and use the App through Family Sharing, volume purchasing, or Legacy Contacts, where those Apple features allow it. That access does not transfer ownership of the App. The App remains licensed, not sold.

20.3. Maintenance and support. The Developer is solely responsible for maintenance and support of the App, as this Agreement describes or as applicable law requires. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support for the App.

20.4. Warranty. The Developer is solely responsible for any product warranty, express or implied by law, to the extent it is not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the Developer’s sole responsibility. Refunds of in-app subscriptions and other in-app purchases are also handled by Apple under Apple’s payment rules (see Section 4b).

20.5. Product claims. You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing claims by you or any third party relating to the App or to your possession or use of the App. Those claims include: (i) product-liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation, including in connection with the HealthKit and HomeKit frameworks where the App uses them. This Agreement does not limit the Developer’s liability to you beyond what applicable law permits.

20.6. Intellectual-property claims. You and the Developer acknowledge that, if a third party claims that the App, or your possession and use of the App, infringes that third party’s intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of that claim.

20.7. Legal compliance. You represent and warrant that (i) you are not located in a region that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a ā€œterrorist supportingā€ region, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

20.8. Developer name and contact. Direct questions, complaints, and claims about the App to the Developer, not to Apple: LitFinger Studio s.r.o., Budilova 161/15, Plzeň, 301 00, Czech Republic; email support@litfinger.com; telephone +420 774 983 570.

20.9. Third-party terms. You must comply with applicable third-party terms when using the App. That includes the agreement for your wireless data service and the Apple or Google terms that apply to your store account, device, and purchases.

20.10. Third-party beneficiary. You and the Developer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement for an App Store copy. Upon your acceptance of this Agreement, Apple has the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

By using the App, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions of this Agreement. If you do not agree to these terms, please do not install or use the App.
